You agree not to use the services in any way that could damage, disable, overburden, or impair the services or interfere with any other party's use and enjoyment of the services.
Accounts
To access certain parts of our website, you may need to create an account. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
You must provide accurate and complete information when registering your account.
Changes to Services
We reserve the right to modify or discontinue any part of or the entire service at any time without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the service.
Copyright
All content on Hostingplanet.org, including text, graphics, logos, icons, images, audio clips, and software, is our property or provided with permission from its owner and is protected by Swedish and international copyright law.
Disclaimer
The services are provided 'as is' and 'as available'. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
We do not warrant that the services will be error-free or uninterrupted.
Limitation of Liability
We shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for lost profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages).
Changes to the Terms
We reserve the right to make changes to these Terms at any time. Your continued use of the website and services after such changes take effect signifies your acceptance of the new Terms.
Conditions
All customers are responsible for monitoring their storage and bandwidth usage each month. Customers who exceed their account limit will receive an email with the option to either upgrade their account or reduce storage. If customers continue to exceed the limit, we will do our best to resolve the issue. We reserve the right to suspend accounts due to repeated issues. If customers sign up for an account and cancel it within the first month, they will still be charged for the entire first month.
Payments
Renewal notices are sent via email 7 days before the actual renewal date of your account. If you use a credit card, you do not need to worry about manual payments. All accounts are set on a prepay basis. Hostingplanet reserves the right to change prices at any time unless other terms have been agreed upon. An account that is not current within a week (7 days) after the email notice or that exceeds this timeframe in any way is subject to suspension. YOU are responsible for all charges owed on the account from the time it was established to the time YOU notify Hostingplanet to request termination of services. Although we are based in Sweden, our website currency is USD, EURO, and SEK. YOUR specific billing cycle corresponds to the contract length originally selected at setup. YOUR account will automatically renew at this length unless it is canceled in advance. There is no fee for canceled accounts that have been paid annually. If you cancel an account on the monthly billing cycle Hostingplanet cannot refund any payments made previously.
All annual payments are non-refundable after the 30-day money-back guarantee period has passed. The only time your annual plan will be terminated is if your account does not comply with our terms of use/acceptable use policy. Both monthly and annual payments are non-refundable if your account does not comply with our terms of use/acceptable use policy.
Cancellation and Early Termination
Customers must acknowledge that the amount of the purchased services is based on the customer's agreement to pay the fee for the initial period or renewal period.
Server Abuse
Any attempt to undermine or cause harm to a server or a customer of Hostingplanet is strictly prohibited.
Hostingplanet will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include 'Internet fraud' (tricking other people into releasing their passwords), password theft, security hole scanning, etc.
Any unauthorized use of accounts or computers by YOU, whether the attacked account or computer belongs to Hostingplanet, will result in action against YOU. Possible actions include warnings, account suspension or termination, and civil or criminal legal action, depending on the severity of the attack.
IMPORTANT NOTE - Hostingplanet reserves the right to discontinue service, or deny access to anyone who violates our policies or the terms listed below WITHOUT WARNING or PRIOR NOTICE. No refunds of fees paid will be made if an account
Technical Support Limitation
Hostingplanet provides technical support to YOU that encompasses our area of expertise. This expertise includes assistance, troubleshooting, and debugging of our cPanel control panel interface, servers within our immediate responsibility, and other hosting-related issues.
Unlike many web hosting companies, we do our best to help with scripts, templates, and programming languages. However, Hostingplanet is under no obligation to help YOU with the installation of new application modules, templates, and/or programming languages, or to provide assistance for any errors caused by applications that YOU have previously modified.
CGI Scripts
Each shared web hosting account comes with its own CGI-BIN. YOU are free to use any CGI scripts YOU wish, but we reserve the right to disable any CGI script that affects the normal operation of a shared server without prior notice.
Indemnity
The customer agrees to indemnify and hold Hostingplanet, its affiliates, and each of their respective officers, directors, agents, and employees harmless from and against any claims, demands, liabilities, obligations, losses, damages, fines, punitive damages, interest amounts, costs and expenses of any kind (including reasonable attorney's fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of the customer's services in violation of applicable law or AUP by the customer or any person using the customer's login information, whether or not such person has been authorized to use the services by the customer.
YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD Hostingplanet HARMLESS FROM LIABILITY ARISING OUT OF:
(1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH Hostingplanet'S SERVER.
(2) ANY MATERIAL SUPPLIED BY THE CUSTOMER THAT INFRINGES OR ALLEGEDLY INFRINGES ON THE RIGHTS OF A THIRD PARTY
(3) COPYRIGHT INFRINGEMENT AND
(4) SOME FAULTY PRODUCTS THAT WERE SOLD TO THE CUSTOMER FROM Hostingplanet'S SERVER.
Warranty Disclaimers
Hostingplanet does not guarantee or represent that the services will be uninterrupted, error-free, or completely secure. To the extent permitted by applicable law, Hostingplanet disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by applicable law, all services are provided on an 'As Is' basis.
Limitation of Damages
Neither party shall be liable to the other for lost profits or any indirect, special, incidental, consequential, or punitive damages of any kind, or for damages that could have been avoided by the use of reasonable care, arising in connection with the agreement, even if the party has been advised or should be aware of the possibility of such damages.
Notwithstanding anything else in the agreement to the contrary, the maximum aggregate liability of Hostingplanet and any of its employees, agents, or affiliates, under any theory of law (including breach of contract, tort, strict liability, and infringement) shall be a payment of money that does not exceed the amount paid by the customer for three months of service.
Suspension of Services/Termination
The customer agrees that Hostingplanet may suspend services to the customer without notice and without liability if: (i) Hostingplanet reasonably believes that the services are being used in violation of the AUP; (ii) the customer does not cooperate with a reasonable investigation of any suspected violation of the AUP; (iii) Hostingplanet reasonably believes that suspension of the service is necessary to protect its network or its other customers, or (iv) as requested by a law enforcement or regulatory agency. The customer shall pay Hostingplanet a reasonable reinstatement fee if service is Hostingplanet after a suspension of service.
Requests for Customer Information
The customer agrees that Hostingplanet may, without notice to the customer, (i) report to the appropriate authorities any conduct by the customer or any of the customer's customers or end users that Hostingplanet believes violates applicable law, and (ii) provide any information that it has about the customer or any of its customers or end users in response to a formal or informal request from a law enforcement or regulatory agency or in response to a formal request in a civil action that on its face meets the requirements for such a request.
Backup
The customer is responsible for maintaining a current copy of all content hosted by Hostingplanet notwithstanding any agreement by Hostingplanet to provide backup services.
Request for Restoration of Hosting Package
During any service period, the customer may request one free restoration for any reason. If a customer needs to request a restoration.
Changes to Hostingplanet's Network
Upgrades and other changes to Hostingplanet's network, including but not limited to changes in its software, hardware, and service providers, may affect the display or operation of the customer's hosted content and/or applications. Hostingplanet reserves the right to make changes to its network at its commercially reasonable discretion, and Hostingplanet shall not be liable for any resulting harm to the customer.
Notices
Notices to Hostingplanet under the agreement shall be given via electronic mail to the email address provided for customer support. Notices to the customer shall be given via electronic mail to the individual designated as the primary customer contact on the order. Notices are deemed received the day they are sent, or if that day is not a business day, the first business day following the day delivered. The customer may change its notice address by a notice given in accordance with this section.
Force Majeure
Hostingplanet shall not be in default under the agreement if the failure to perform is due to an event beyond Hostingplanet's control, including but not limited to significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.
Governing Law/Disputes
The agreement shall be governed by the laws of Södermanland, except for its law on conflicts of laws, and the laws of Sweden, to the extent applicable. The agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
File Storage
All files stored on Hostingplanet's servers must be legally owned and accompanied by a valid license and/or copyright. This includes, but is not limited to, MP3, AVI, MID, MIDI, MPG, MPEG, MOV, EXE, ISO. If we discover any unlicensed and/or illegal files on YOUR account, these files will be deleted.
Service Cancellation
Hostingplanet reserves the right to terminate a service at any time. All pre-paid fees for termination will be refunded by Hostingplanet if we initiate the termination. Any violation of policies resulting in extra costs will be charged to YOU.
Promotional Prices & Special Offers
Hostingplanet may offer subsequent promotional prices or special offers, the terms of which may be more or less favorable than the terms and conditions of YOUR Services. Any such promotions or modifications shall not affect YOUR obligations under this agreement. Promotional rates may be subject to additional terms which, to the extent they conflict with the terms of this agreement, shall have precedence. Different promotional rates and special offers may not be combined with each other.
We have various special promotions that include a domain name. The cost of this domain name is usually covered by the first month's payment. As a result, our promotions are non-refundable and are not covered by our 30-day money-back guarantee.
Intellectual Property Rights
Material made available to you through Hostingplanet's services may be protected under Swedish or other copyright laws, or laws that protect trademarks, trade secrets, and proprietary information. Except when expressly permitted by the rights holder, YOU may not use Hostingplanet or its servers and network in a way that would infringe, violate, dilute, or otherwise improperly exploit such rights, with respect to any material that you access or receive through Hostingplanet's network. If YOU use a domain name in connection with Hostingplanet or similar service, YOU may not use that domain name in violation of any third party's trademarks, service marks, or similar rights.
Network Security
Customers may not use Hostingplanet's network to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for YOU, logging into a server or account that YOU are not expressly authorized to access, password cracking, probing the security of other networks in search of weaknesses, or violating the security policy of another organization. YOU may not attempt to interfere with or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Hostingplanet will cooperate fully with investigations of violations of system or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.
E-commerce
YOU will be solely responsible for the development, operation, and maintenance of YOUR online store and products, along with all content and materials displayed online or on YOUR products, including without limitation:
(a) the accuracy and appropriateness of content and materials displayed in the store or related to YOUR products,
(b) ensuring that the content and materials displayed in the store or related to YOUR products do not infringe or violate the rights of any third party, and
(c) ensuring that the content and materials displayed in the store or related to YOUR products are not defamatory or otherwise illegal. YOU will be solely responsible for the final calculation and application of shipping and sales tax. YOU will also be solely responsible for accepting, processing, and fulfilling orders.
Ownership of IP Addresses
Hostingplanet retains and controls ownership of all IP numbers and addresses that may be assigned to you. Hostingplanet reserves the right to change or remove any such IP numbers and addresses at its sole discretion.
Domain Name Registration
You agree to pay Hostingplanet in advance before the desired domain name registration becomes effective, the then-current amount according to Hostingplanet's price list for initial domain name registration and, if you choose to renew the registration, subsequent renewals. All fees are non-refundable, in whole or in part, even if your domain name registration is suspended, canceled, or transferred before the end of your current registration period. Hostingplanet reserves the right to change fees, additional charges, renewal fees, or impose new fees at any time, for any reason, at its sole discretion. Your desired domain name will not be registered until we receive payment of the registration fee and confirm your registration in an email from Hostingplanet to the email address provided in your registration application. In the event of a refund from a credit card company (or similar action by another payment provider allowed by Hostingplanet) in connection with the payment of the registration fee for your domain name, you agree and acknowledge that the domain name registration will be transferred to Hostingplanet as the paying party for that registration to the registry, and we reserve all rights regarding such domain name, including, but not limited to, the right to make the domain name available to other parties for purchase. Hostingplanet will only restore your domain name registration at its sole discretion, and depending on our receipt of the initial registration or renewal fee and our then-current restoration fee.
Legal Purpose
Hostingplanet reserves the right to refuse service to anyone. YOU may only use Hostingplanet's server for lawful purposes and our services may not be used for unlawful purposes or to support unlawful activities. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of suspected crimes or civil wrongs. If something is not legal in Sweden, it is not permitted on our servers. Transmission, distribution, or storage of material that violates any applicable law or regulation is prohibited. This includes but is not limited to material protected by copyright, trademark, trade secret, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an unlawful threat, or violates export control laws. Examples of unacceptable content or links: 'Pirated Warez', OGG, AVI, MPEG, ISO, 'Hacker programs or archives', 'Copyright-protected digital movie copies (DIVX)', and 'Unlicensed MP3'. The designation of such materials as described above is entirely up to Hostingplanet's management discretion.
If illegal content or usage is discovered, the account will be suspended and/or terminated. YOU agree that Hostingplanet may disclose all your information including assigned IP numbers, account history, account usage, etc., to any law enforcement authority making a written request without further consent or notification.
Regardless of where this agreement is signed, YOU agree that for the purpose of venue, this contract is entered into in Sweden, and any disputes will be litigated or arbitrated in Sweden. Respondent further waives all objections to venue and acknowledges that the venue for any litigation will be held in Swedish courts. UNDER NO CIRCUMSTANCES SHALL Hostingplanet'S MAXIMUM LIABILITY EXCEED FIVE HUNDRED (500.00) DOLLARS.
